Terms of Service

The agreement between you and ilzion when you use our platform.

Welcome to ilzion, a live multiplayer quiz platform where hosts create quizzes and players join quizzes by PIN with a nickname. These Terms of Service (the “Terms”) are a binding legal agreementbetween you and ilzion, which is operated by an individual sole operator (“ilzion”, “we”, “us”, or “our”). They cover your access to and use of our website at https://www.ilzion.comand any related services, features, and content (together, the “Service”).

Please read these Terms carefully. By accessing or using the Service, you agree to be bound by them. If you do not agree, please do not use the Service. These Terms work alongside our Privacy Policy, Cookie Policy, Acceptable Use Policy, and Community Guidelines, which are incorporated into these Terms by reference.

1. Acceptance of these Terms

By creating an account, joining a quiz, or otherwise accessing or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by the policies referenced above. If you use the Service on behalf of an organization (for example, a school, a team, or a business), you represent that you are authorized to accept these Terms on its behalf, and “you” refers to that organization.

Players who simply join a quiz by PIN with a nickname, without creating an account, also agree to these Terms and our policies by participating in that quiz.

2. Eligibility & age

ilzion is available to a general audience of all ages. Players can join quizzes anonymously by nickname without creating an account, so younger participants can take part without us collecting account data from them.

You must be at least 13 (or the minimum digital-consent age in your country, whichever is higher) to create an account. To create an account and host or build quizzes, you should also be old enough to enter into a binding agreement in your country, or you should use the Service with the involvement of a parent, guardian, or teacher. If you are using ilzion in a classroom or with minors, you are responsible for obtaining any consents required in your jurisdiction and for supervising those participants. 3. Your account

Some features require an account. When you register, you agree to provide accurate and current information and to keep it up to date. You are responsible for:

  • Accuracy. Providing a valid email address and truthful account details.
  • Security. Keeping your password confidential and not sharing your login. We hash passwords and never store them in plain text, but the security of your credentials on your side is your responsibility.
  • Responsibility. All activity that happens under your account, including quizzes you create and quizzes you host, and any connected streaming accounts (Twitch, YouTube, or Kick) you choose to link.

Notify us promptly at security@ilzion.com if you suspect unauthorized use of your account. You can review and update your details at any time in your account settings.

4. The Service

ilzion lets account holders create quizzes and questions (including images, audio, or video they upload) and host live quizzes. Other people join those quizzes by entering a PIN and choosing a nickname and avatar, then answer questions in real time, earning scores and streaks. We may add, change, or remove features over time as the Service evolves.

ilzion is self-hosted: our database, authentication, storage, realtime, cache, and web server run on our own private server infrastructure. We do not run third-party analytics, advertising, or behavioral tracking on the Service.

5. Your content & the licence you grant us

You retain ownership of the content you create or submit through the Service, including quiz titles, descriptions, questions, answers, explanations, uploaded media, display names, and nicknames (“Your Content”). You are responsible for Your Content and for making sure you have the rights to use and share it.

To operate the Service, you grant ilzion a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, resizing an image), and display Your Content solely for the purpose of providing and improving the Service — such as showing your quiz to players in a quiz you host. This licence is limited to running the Service for you; we do not sell Your Content or use it for advertising. The licence ends when you delete the relevant content or your account, except for content already shared in a quiz and for routine backups that age out over a normal rotation period.

You represent that Your Content does not infringe anyone’s rights and does not violate our policies. We may remove content that breaches these Terms or the policies referenced below.

6. Acceptable use

Your use of the Service must follow our Acceptable Use Policy and Community Guidelines. In short, you agree not to misuse the Service, including by:

  • Posting unlawful, harassing, hateful, or harmful content;
  • Infringing intellectual property or privacy rights;
  • Attempting to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service;
  • Using bots, scraping, or automated abuse, or evading kicks, blocks, or rate limits;
  • Impersonating others or misrepresenting your affiliation.

We use a randomly-generated device identifier only to enforce per-quiz kick and block lists for anti-harassment; this is described in our Cookie Policy and is not used for tracking.

7. Hosting and playing quizzes

If you host a quiz, you are responsible for the quiz content you present and for moderating your quiz, including removing disruptive participants. If you join a quiz as a player, you agree to choose an appropriate nickname and avatar and to behave respectfully toward the host and other players. Hosts may kick or block participants whose behavior breaches our policies. We may also intervene where the Service is being misused.

8. Intellectual property

The Service itself — including the ilzion name and logo, the software, design, interface, and all related materials — is owned by ilzion and protected by intellectual property laws. Except for Your Content and the rights expressly granted in these Terms, nothing here gives you any right to use ilzion’s marks, branding, or proprietary materials without our prior written permission. We grant you a limited, personal, non-transferable, revocable licence to use the Service in accordance with these Terms.

9. Paid plans & subscriptions

Paid plans are subscriptions that renew automatically at the end of each billing period (monthly or yearly) at the then-current price, until you cancel. The price, billing cycle, and your next renewal date are shown to you at the point of purchase and on every receipt; by confirming, you agree to pay those fees and authorize us (or our payment processor) to charge your chosen method for each renewal until you cancel. You can cancel at any time, as easily as you subscribed, from your account settings, and we offer a 14-day money-back guarantee. Full details — including renewals, billing errors, and statutory withdrawal rights — are in our Refund & Cancellation Policy. Some features of the Service are free; we may change which features are free or paid over time.

Card and other online payments are processed by Paddle (Paddle.com Market Limited and its group companies) acting as our Merchant of Record and authorized reseller. For those transactions Paddle is the seller of record: it charges your payment method, collects any applicable taxes, and issues the receipt, and your purchase is also governed by Paddle's Buyer Terms. Card subscriptions may renew automatically at the start of each billing period until you cancel. You can cancel at any time in your account settings or by contacting us; cancellation stops future renewals and takes effect at the end of the period you have paid for.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We take reasonable measures to protect the Service, but no online service can be guaranteed to be free from vulnerabilities. For more detail, see our Disclaimer and Security pages.

11. Limitation of liability

To the fullest extent permitted by law, ilzion will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Service. Where liability cannot be excluded, our total aggregate liability to you for all claims relating to the Service is limited to the greater of (a) the total amount you paid us for the Service in the three (3) months before the event giving rise to the claim, or (b) USD 100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless ilzion from and against any claims, damages, liabilities, and reasonable costs (including legal fees) arising out of or related to: (a) Your Content; (b) your use of the Service; (c) your breach of these Terms or the policies referenced here; or (d) your violation of any law or the rights of a third party. We may assume the defense of any matter subject to indemnification, and you agree to cooperate with us in doing so.

13. Suspension & termination

You may stop using the Service at any time and may delete your account through your account settings, via account deletion, or by contacting privacy@ilzion.com (see our Data Deletion page). We may suspend or terminate your access if you breach these Terms or our policies, if required by law, or to protect the Service or other users. Where reasonable, we will give notice. Provisions that by their nature should survive termination — such as content licences already exercised, intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

14. Changes to the Service & these Terms

We may update these Terms from time to time, for example to reflect new features or legal requirements. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms. We may also modify, suspend, or discontinue parts of the Service at any time.

15. Governing law & dispute resolution

These Terms are governed by the laws of the Republic of Azerbaijan, without regard to conflict-of-laws rules. We refer to this jurisdiction below as the “governing jurisdiction”.

Informal resolution first. Before starting any formal proceedings, you and ilzion agree to first try to resolve any dispute informally. The party raising the dispute will describe it in writing by contacting legal@ilzion.com, and the parties agree to attempt in good faith to resolve the matter through that contact email for a period of thirty (30) days before either party begins formal proceedings.

Forum. If a dispute cannot be resolved informally within that period, it will be subject to the competent courts of the Republic of Azerbaijan, except where applicable law gives you the right to bring proceedings elsewhere.

Binding arbitration. Except for the small-claims and consumer-rights carve-outs in this §15, any dispute that cannot be resolved informally will be resolved by final and binding individual arbitration rather than in court, before a single arbitrator under the rules of a recognised arbitral institution, with the seat being the governing jurisdiction unless applicable law requires otherwise. Judgment on the award may be entered by any court of competent jurisdiction.

Class-action waiver. To the fullest extent permitted by applicable law, you and ilzion each agree to bring claims only in an individual capacity, and notas a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any form of class or representative proceeding.

Small-claims carve-out.Nothing above prevents either party from bringing an individual claim that qualifies in a small-claims court (or equivalent), where the claim and the parties meet that court’s requirements.

Your mandatory consumer rights are preserved. Nothing in this §15 or in these Terms limits, waives, or removes any non-waivable statutory rights you have as a consumer — including under EU, UK, or other applicable consumer-protection law — or any right you may have, where the law so provides, to bring proceedings in, or have a dispute governed by the law of, the country in which you reside. Where applicable law does not permit the arbitration or class-action-waiver provisions above to be enforced against you, those provisions do not apply to you to that extent, and your mandatory rights prevail.

16. Data Processing Agreement

If you are a business or education customer that uses ilzion to process personal data for which you act as the data controller, you may request a Data Processing Agreement (DPA) to govern our processing of that data on your behalf. A template DPA is available at /dpa. This is a template for review and is not a substitute for legal advice.

17. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a reorganization or transfer of the Service. These Terms, together with the policies referenced above, are the entire agreement between you and ilzion regarding the Service.
